Board of Contract Appeals General Services Administration Washington, D.C. 20405 _____________________ May 16, 2005 _____________________ GSBCA 16584-RELO In the Matter of JAMES GREGORY MILLS James Gregory Mills, FPO Area Pacific, Claimant. Rebecca Lott, Comptroller, United States Naval Air Pacific Repair Activity, FPO Area Pacific, appearing for Department of the Navy. BORWICK, Board Judge. The agency seeks reconsideration of our decision in James Gregory Mills, GSBCA 16584-RELO (Mar. 25, 2005). In Mills claimant sought reimbursement of $5095 for non- temporary storage during claimant's overseas tour of duty. Before the Board, the agency disputed entitlement, but did not dispute the amount claimed. Therefore, we granted the claim and found that the agency owed $5095. In its motion for reconsideration, the agency now informs us that the $5095 included a refundable deposit and claimant's advance payment for several years of non-temporary storage. The agency states that it would owe claimant a maximum of $4950, based upon a payment schedule of $90 per month for November and December 2001, and $81 per month for April 2001 through March 2005, with continuing payments from April through November 2005 should claimant remain at his present overseas duty station. The agency notes that claimant's transportation agreement ends in October 2005 and that if he has a permanent change of station in October, he will not be eligible for non-temporary storage reimbursement in December 2005. The agency also notes that claimant might choose to accept another position and relocate before October. In response to the agency's motion, claimant states that he accepts the agency's method of calculation. Based on the good cause shown, the Board grants reconsideration and accepts the agency's payment schedule as the basis for the agency's payment of this claim. __________________________ ANTHONY S.
